  1. Subject

1.1. This document (hereinafter the "Privacy Policy") aims to describe the conditions under which VELVET CONSULTING (hereinafter "VELVET") collects and processes personal data (hereinafter "Data") of internet users (hereinafter "User" or "you") during their use of the website www.velvetconsulting.com (hereinafter "the Site") as described in the "General Terms of Use of the Site."

Any individual connecting to or using the Site acknowledges having fully read the Privacy Policy at the time of their connection.

Velvet is responsible for processing the data it collects from Users using the Site in accordance with Regulation (EU) 2016/679 of April 27, 2016, relating to the protection of individuals concerning the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

  1. Data collected

2.1. VELVET collects the data provided by the User during their registration on the Site.

The data collected and subsequently processed by VELVET are those that the User voluntarily transmits to VELVET via the candidate or recruiter registration form (hereinafter "the Form") to allow their identification. These data include, at a minimum:

 

For clients:

  • User's title, name, and first name;
  • User's company and position;
  • User's email address and phone number;
  • User's free field.

 

For candidates:

  • User's title, name, and first name;
  • User's email address and phone number;
  • Type of job offer chosen by the User;
  • The User has the option to attach their CV and cover letter containing personal data (postal address, ...);
  • No other personal data is collected unless the User enters personal data in the free field or on their CV/cover letter.
  • Aucune autre donnée personnelle n'est collectée sauf si l’Utilisateur met des données personnelles dans le champ libre ou sur son CV / Lettre de motivation.

Any other information is provided voluntarily by the User to improve the services provided.

The data identified as mandatory within the form is necessary to enable the User to benefit from the Site's features.

Users who do not wish to provide any of this data will not be able to complete their registration.

 

2.2. When the User registers on the Site, they are asked to choose a sufficiently complex password.

The User expressly agrees to maintain the confidentiality of their password.

The User agrees not to use the profiles, usernames, or passwords of another User, nor to disclose their password to third parties.

The User expressly agrees to inform VELVET promptly if they suspect unauthorized use of their profile or access to their password.

The User remains solely responsible for any use of their profile.

The information provided by the user through the forms available on the site is intended for authorized personnel of the Company for administrative, marketing, and commercial management purposes.

All data collected:

  • are obtained and processed fairly and lawfully;
  • are recorded for specific and legitimate purposes;
    • sare used in accordance with these purposes;
    • are adequate, relevant, and not excessive in relation to these purposes;
  • are subject to precautions to ensure the security and confidentiality of the data to prevent them from being damaged, modified, destroyed, or disclosed to unauthorized third parties.

VELVET also records usage data when the User accesses the Site. VELVET performs audience measurements, measuring, for example, the number of pages viewed, the number of visits to the Site, as well as the activity of visitors on the Site and their frequency of return. VELVET uses login identifiers and cookies to identify the User and record their activity.

VELVET may also collect technical data about the User's internet connection, browser, and devices.

 

  1. Collection Purposes

The data collected through the Form allow the User to benefit from the Site's features.

The collection aims to:

  • Allow the Company and its subsidiaries to respond to requests from Site Users, especially applications submitted in response to job offers, internships, and spontaneous applications, or to contact users by email to keep them informed on certain subjects;
  • Allow the User to access the interactive areas of the Site;
  • Send Users the Company's publications with their consent;
  • Respond to User complaints, questions, and information requests;
  • Improve and personalize the User's customer experience by providing access to customer service and offering responses tailored to the User's needs;
  • Conduct statistics and marketing analyses to understand how you use the Site;
  • More generally, enable the operation of the Site.

 

  1. Data recipients

All Data concerning the User remains confidential.

The Data collected is intended for persons responsible for information processing within the Company and its subsidiaries.

The Data collected by the Company on the Site is for internal use only and is not subject to any communication, transfer, or disclosure to third parties without the express and written authorization of the concerned User, except for legal or judicial constraints.

However, certain Data may be transmitted to partners mandated by VELVET. These partners are not authorized to disclose this data.

Data collected related to responses to job and internship offers on the Site and spontaneous applications are intended for personnel responsible for recruitment within the Company and its subsidiaries to process the application process and its possible presentation to clients as part of missions entrusted to VELVET.

This Data may also be communicated by VELVET, its members, or its mandated partners if required by law, regulation, or a decision rendered by a regulatory or judicial authority.

Users of the Site, however, grant the Company the right to share all collected information with its clients, suppliers, subcontractors, and subsidiaries if necessary for the realization of the above-mentioned processing. In this case, rectifications and/or cancellations of personal information will be notified to said suppliers, subcontractors, subsidiaries, or affiliated companies.

The Data collected is accessible to our service providers, acting as subcontractors, who contribute administratively and technically to the achievement of the purposes mentioned above.

In this context, the data we collect may be transferred outside the European Union. In this case, Velvet ensures that this transfer takes place to countries recognized as providing an adequate level of protection for your personal data or, at the very least, on the basis of appropriate guarantees provided by law.

 

  1. Data retention

The Data is stored with the Site's host and is kept for the entire duration necessary for the purposes specified above.

Regarding recruitment data, the duration is 5 years after the last contact with the candidate.

Navigation data will be kept for a maximum of 6 months following the recommendations of the CNIL.

 

 

  1. Data security

VELVET attaches particular importance to the security of User Data and implements all appropriate measures to ensure its adequate security and restrict access through physical, technical, or organizational measures relevant to the state of the art, including protection against unauthorized or unlawful processing and against loss, theft, deterioration, misuse, destruction, or damage by accident.

Depending on the needs, risks, costs, and processing purposes, these measures may include pseudonymization and data encryption.

 

  1. Right of Access and Rectification of Data

The User has the right of access, rectification, modification, limitation, portability, deletion, and erasure of incomplete, inaccurate, or outdated Data related to their use of the Site. To exercise their rights, the User must write to the following address: VELVET, 64, Rue la Boétie, 75008 PARIS.

Users also have the right to object to the processing of their Data for legitimate reasons, as well as the right to object to the use of this data for commercial prospecting purposes.

Furthermore, the collection of certain data may be required for regulatory or contractual reasons. The data subject is thus required to provide the requested personal data.

 

  1. Cookies

VELVET may use cookies to improve tracking of User preferences and Site configuration.

While browsing the Site, a cookie is placed on the User's computer's hard drive. This cookie is intended to record information about the User's browsing on the Site (date and time of consultation, page viewed, date and time of click, location of click, etc.). This information allows VELVET to personalize the Site and facilitate access to sections. The duration of storing this information on the User's computer is 15 days.

VELVET may also process the User's personal information to personalize the information published on the Site or inform the User about new service offers, unless the User has objected.

  1. Modification of the Privacy Policy

9.1. VELVET reserves the right to modify its Data protection policy at any time and to apply these possible modifications to all Data it holds concerning the User.

9.2. Any consultation by the User of the Site after the effective date of these modifications on the Site constitutes acceptance by the User of the revised Data protection policy.

Therefore, it is advisable for the User to regularly review this document to be fully informed of any modifications made by VELVET.
